Giao đất, cho thuê đất là một trong những hoạt động giúp Nhà nước phân phối đất đai một cách hiệu quả. Các quy định về giao đất, cho thuê đất theo Luật Đất đai năm 2013 bước đầu phát huy nguồn lực đất đai cho sự phát triển mọi mặt của nền kinh tế-xã hội. Tuy nhiên, trong quá trình thực hiện đẵ phát sinh một số điểm hạn chế, bất cập và đang được tiếp tục hoàn thiện trong Dự thảo Luật Đất đai (sửa đối). Trong phạm vi bài viết, tác giả tập trung đánh giá và đưa ra một số góp ý cho Dự thảo Luật Đât đai (sửa đôi) về cơ chế giao đất, cho thuê đất nhằm hướng tới bảo đảm quyền của các chủ thế và phù hợp với cơ chế thị trường, đẩy mạnh thu hút đầu tư, huy động được nguồn lực cho phát triển kinh tế-xã hội của đất nước.

Land allocation and land lease is one of the activities that enables the State to distribute land effectively. The provisions on land allocation and land lease in the Land Law 2013 has initially promoted the land resource to the overall development of the economy and society. However, during the process of implementation, a number of shortcoming and inadequecies have arisen and are currently improved in the Draft of the Land Law (amended). Within the scope of the article, the author focuses on assessing and recommending some suggestions to the Land Law draft on the regime of land allocation and land lease with an aim to guarantee the rights of subjects and be in accordance with the market regime, enhance the attraction for investment, utilize resources for the the socio-economic development of Vietnam.
